With the availability ofpresymptomatic tests for late-onset disordersand the possibilities of prevention andtreatment, the conflict between directivenessand non-directiveness will dominate thecounseling setting. Despite general consent onproviding genetic information in a nondirectivefashion to preserve value neutrality andenhance client's autonomy, there is no acceptedcommon definition of what non-directivenessreally is or (...) ought to be. Germany has just started a public debate on priority-setting, rationing and cost-effectiveness due to the cost explosion within the German health care system. To date, the costs for German health care run at 11,6 % of its Gross Domestic Product (GDP, 278,3 billion €) that represents a significant increase from the 5,9 % levels present in 1970. In response, the German Parliament has enacted several major and minor legal reforms over the last three decades for the sake of cost containment (...) and maintaining stability of the health care system. The Statutory Health Insurance—SHI (Gesetzliche Krankenversicherung—GKV) is based on the fundamental principle of solidarity and provides an ethical and legal framework for implementing equity, comprehensiveness and setting the principles and rules for financing and providing health care services and benefits. Within the SHI system, several major actors can be identified: the Federal Ministry of Health, the 16 state ministries of health, the Federal Joint Committee (G-BA), the physicians (with their associations) and the hospitals (with their organizations) on the provider side, and the sickness funds with their associations on the purchasers’ side. This article reviews the structure and complexities of the German health care system with its major players and participants. The focus will be put on relevant ethical, legal and economic aspects for prioritization, rationalization, rationing and cost-effectiveness of medical benefits and services. In conclusion, this article pleads for open discussion on the challenging subject of priority-setting instead of accepting the implicit and non-transparent rationing of medical services that currently occurs at many different levels within the health care system, as it stands today. This book explores the implications of agonistic democratic theory for political practice. Fuat Gürsözlü argues that at a time when political parties exacerbate political division, political protesters are characterized as looters and terrorists, and extreme partisanship and authoritarian tendencies are on the rise, the agonistic approach offers a much-needed rethinking of political practice to critically understand challenges to democracy and envision more democratic, inclusive, and peaceful alternatives. Inspired by Chantal Mouffe’s agonistic theory and drawing on insights of other prominent (...) agonistic scholars, Gürsözlü offers a distinctive approach that develops the connections between the agonistic approach and political practice. His main claim is that approaching democratic politics from an agonistic perspective changes the way we understand the nature of democratic society, the place of political protest in democracy, the nature of adversarial engagement, and the democratic function of political parties. The book also advances an account of agonistic peace that is best fitted to the pluralistic and inherently conflictual nature of democratic societies. Leaders in today's world face the challenge of earning the trust and commitment of organizational members if they expect to guide their companies to success in a highly competitive global context. In this article, we present empirical results indicating that when leadership behaviors are perceived as trustworthy through the observer's mediating lens, trust increases and leaders are more likely to be viewed as ethical stewards who honor a higher level of duties. The question of Turkey's membership in the EU has been the subject of debates about the cosmopolitan future of Europe. Using the concept of cosmopolitanism as developed by Beck, Habermas, and Delanty, this article argues that the possibility of an antiontological and multicultural cosmopolitan European community will largely depend on how Europe answers the question of whether Turkey should be granted membership in the EU. Turkey forces a debate on three crucial areas that are directly related to the cosmopolitan future (...) of Europe: (a) Europe's geopolitical place in the global world, (b) postnational forms of a European public sphere, and (c) European identity. The potential for a multicultural and pluralistic cosmopolitanism is a two-way street, and while Turkey's membership will have a transformative impact on the EU, the membership process will also have a similar impact on Turkish democracy and modernity. Trust within a secular or organizational context is much like the concept of faith within a religious framework. The purpose of this article is to identify parallels between trust and faith, particularly from the individual perspective of the person who perceives a duty owed to him or her. Betrayal is often a subjectively derived construct based upon each individual's subjective mediating lens. We analyze the nature of trust and betrayal and offer insights that a wise believer might use in understanding (...) his or her relationship with the divine. We suggest that the parallels between trust and faith involve a willingness to relinquish one's power or control in the expectant hope that our needs will be met. Betrayal, however, is often profoundly misunderstood. (shrink)

Zusammenfassung. Inzwischen ist „Dolly” mehrfach durch die Klonierungen anderer Säugetiere hinreichend bestätigt worden. Im Januar 1999 sollen Koreanische Forscher sogar den ersten menschlichen Embryo kloniert haben. Im folgenden werden zunächst biologisch-technische Grundlagen aktueller Klonierungstechnologien des Embryo-Splittings und der Zellkerntransplantation vorgestellt. Anschließend folgt eine kurze ethische Bewertung der Klonierung beim Menschen, wobei das Klonen als ein Verstoß gegen die Menschenwürde klassifiziert wird. Seit der Verabschiedung des Embryonenschutzgesetzes (ESchG) im Januar 1991 sind jetzt über neun Jahre vergangen. In Anbetracht der wissenschaftlichen Erkenntnisse (...) und des technischen Fortschrittes auf dem Gebiet der Reproduktionsmedizin in den letzten Jahre meldet das ESchG nicht nur zunehmenden Interpretationsbedarf an, sondern weist auch z.T. gravierende Strafbarkeitslücken auf. Mit dem vorliegenden Beitrag soll ein Stück weit eine auf der Basis des naturwissenschaftlichen Fortschritts fundierte ethisch-rechtliche Diskussion insbesondere vor dem Hintergrund des in die Jahre gekommenen deutschen ESchG angeregt werden. Definition of the problem: Recently, ”Dolly” has been confirmed by cloning several other mammals. In January 1999 it was even reported that Korean researchers first of all had cloned the first human embryo. In the following article some basic biological and technical aspects of modern cloning strategies, such as embryo splitting and nuclear transplantation, will be described. Subsequently, a short critical analysis will discuss the ethical problem of cloning human beings. Since the German Embryo Protection Act from January 1991 substantial (...) progress in cloning technology has been made, so that the principal question now is whether the Act is still sufficient to forbid human cloning or whether it should be revised. Arguments and conclusion: With advanced technical progress human cloning now seems to be possible. From the ethical point of view, the cloning of human beings should be rejected, as it offends the fundamental value of human dignity. On the other hand, the German Embryo Protection Act is antiquated and does not provide the required protection. This article may stimulate further discussion in the fields of ethics and jurisdiction, especially regarding to the Embryo Protection Act. (shrink)

In this paper an economics approach to assessing community values in health care priority setting is examined. The approach is based on the concept of ‘willingness to pay’ (WTP). Eighty two parents were interviewed with regard to three aspects of provision of child health services. For each aspect a choice of two courses of action was presented. Parents were asked which course of action they preferred and what was the maximum amount of money they would be prepared to pay for (...) this rather than their less preferred option. WTP responses are acceptable to the majority of respondents and appear to ‘behave’ in accordance witha priori expectations. A method of assessing the influence of ability to pay on preferences and WTP is outlined. Preferences and WTP do not appear to have been unduly distorted by ability to pay. Use of WTP data does have the potential to provide health care purchasers and providers with information on intensity as well as direction of the preferences of members of the community. (shrink)

On 25 April 2002, the German Parliament has passed a strict new law referring to stem cell research. This law took effect on July 1, 2002. The so-called embryonic Stem Cell Act ( Stammzellgesetz — StZG ) permits the import of embryonic stem (ES) cells isolated from surplus IvF-embryos for research reasons. The production itself of ES cells from human blastocysts has been prohibited by the German Embryo Protection Act of 1990, with the exception of the use of ES cells (...) which exist already. The debate on the legitimate use of ES cells escalated, after the main German research funding agency, the Deutsche Forschungsgemeinschaft (DFG), unexpectedly published new guidelines recommending are stricted use of human ES cells for research. Meanwhile, the debate has ethically dividedsociety, political parties, government and church members into a group supporting and a group rejecting ES cell research. The arguments in favour of such a research can be summarized as arguments derived from a new ethics ofhealing calling for a therapeutic imperative, whereas the arguments against can be summarized as arguments violating the fundamental principle of human dignity as they imply the destruction of human embryos. This article willtry to present and evaluate various ethical arguments founded on the latest biological and medical data on the potential use of stem cell technologies. It will finally come to the conclusion that ES cell research is opposed to human dignity, since the procedures of isolating ES cells require the destruction and instrumentalization of human embryos. Human embryos are human beings at a very early stage of their development, fully possessing the ability of completing their development. At this very early stage, human embryos are extremely dependent and fragile, and thus vulnerable corporealities. Vulnerability and human dignity demand the protection of the embryo's corporeal integrity. Hence, this essay will try to propagate research with adult stem(AS) cells, a procedure which does not require the destruction of human embryos; with regard to the necessary plasticity, it should be emphasized that AS cells very much resemble ES cells. Deep brain stimulation is an invasive technique designed to stimulate certain deep brain regions for therapeutic purposes and is currently used mainly in patients with neurodegenerative disorders, such as Parkinson’s disease. However, DBS is also used increasingly for other experimental applications, such as the treatment of psychiatric disorders, weight reduction. Apart from its therapeutic potential, DBS can cause severe adverse effects, some that might also have a significant impact on the patient’s personality and autonomy by the external stimulation of DBS (...) which effects lie beyond the individual’s control and free will. The article’s purpose is to outline the procedures of DBS currently used in therapeutic and experimental applications and to discuss the ethical concerns regarding this procedure. It will address the clinical benefit-risk-ratio, the particular ethics of research in this field, and the ethical issues raised by affecting a patient’s or an individual’s personality and autonomous behaviour. Moreover, a potential ethical guideline, the Ulysses contract is discussed for the field of clinical application as well as the question of responsibility. (shrink)

Recent evidence readily confirms that ethical conduct in human interaction has declined in the context of business, but also in virtually every phase of life. An alarming number of government leaders at all levels have demonstrated by their conduct that their primary goal is the pursuit of self-interest for themselves, their party, and their constituents - regardless of whether the choices they make are in the long-term best interests of those whom they are obligated to serve. Academic institutions and their (...) leaders similarly seem to be either tied to past assumptions and traditions that seem, or blatantly out of touch with the needs of their students and the communities that they serve. Increasingly, college and university academic programs are being taught by part-time and temporary faculty who are paid less than their elementary and high school counterparts who lack their educational preparation, level of knowledge, or responsibility in preparing students for their chosen careers. Non-governmental organizations also struggle to earn the respect of the public, and their trustworthiness has been called into question as chief executive officers and staff receive high salaries, but lack accountability for achieving results or acting with integrity. Those who work in the media are as a group no longer trusted to provide an objective and unbiased assessment of the news. Even religious institutions are under attack and their leaders are being asked to be accountable to the standards which their doctrines advocate. Implicit in ethical conduct is the responsibility to identify the far goals of human achievement - rather than short-term interests that undermine long-term value creation and outcomes that best serve society. Abraham Maslow has wisely noted that the pursuit of efficiency must be evaluated in terms of the specific goals intended to be achieved, but the ramifications of individual and collective actions often seem to be out of focus, misdirected, and short-sighted. The Triumph of Liberal Democratic Peace and the Dangers of Its Success” provides an overview of the “liberal democratic peace theory” that is associated with Kant and has been developed by Doyle and other contemporary scholars. The chapter examines the problem of wars that are fought in the name of democracy and the way that the liberal democratic peace theory can end up encouraging military interventions. It argues that a careful understanding of the Kantian democratic peace theory can resist the (...) urge to intervene. It employs Galtung’s notion of cultural violence to provide a critique of interventionist peace action. It concludes by advising that we work to find a way to build bridges between democracies and non-democracies. (shrink)

Sartre's theory of the imagination is important both as an alternative to the idea that the imagination consists of images contained somehow in the mind - the "illusion of immanence" — and as an early formulation of Sartre's conception of consciousness. In this paper I defend Sartre's theory of imaginative consciousness against some of its critics. I show how difficulties with his theory parallel a perennial problem in Sartre-interpretation, that of understanding how consciousness can negate its past and posit possibilities (...) beyond the facticity of its situation. In this short essay I will not provide a detailed exposition of Sartre's theory of the imagination. Rather, I provide the basis of an interpretation of this theory that emphasizes the role that the past plays in imaginative consciousness. (shrink)

Conceptualisation and reasoning involve intellectual operations that can and should be taught. This paper identifies pairs of basic operations in reasoning and conceptualisation that are comparable to the basic operations of arithmetic and just as important. Examples are provided to illustrate how these operations may be introduced in the classroom.

. American businesses and corporate executives are faced with a serious problem the loss of public confidence. Public criticism, increased government controls, and growing expectations for improved financial performance and accountability have accompanied this decline in trust. Traditional approaches to corporate governance, typified by agency theory and stakeholder theory, have been expensive to direct and have focused on short-term profits and organizational systems that fail to achieve desired results. We explain why the organizational governance theories are fundamentally, inadequate to build (...) trust. We advance a conceptual framework based on stewardship theory characterized by “covenantal relationships” and argue that design of governance mechanisms using a covenantal approach is more effective in building trust in organizations. A covenantal relationship is a specialized form of a relational contract between an employee and his or her organization. We argue that regardless of incentives and control mechanisms carefully designed through contractual mechanisms, in the absence of covenantal relationships it is extremely difficult to build trust within organizations. We propose that organizations are more likely to build trust – both at the organizational level and at the interpersonal level – when they create reinforcing and integrated systems that honor implied duties of “covenantal relationships.”. Great leaders are ethical stewards who generate high levels of commitment from followers. In this paper, we propose that perceptions about the trustworthiness of leader behaviors enable those leaders to be perceived as ethical stewards. We define ethical stewardship as the honoring of duties owed to employees, stakeholders, and society in the pursuit of long-term wealth creation. Our model of relationship between leadership behaviors, perceptions of trustworthiness, and the nature of ethical stewardship reinforces the importance of ethical governance in dealing (...) with employees and in creating organizational systems that are congruent with espoused organizational values. Moral education needs to be distinguished from moral training and to find its way into the school curriculum. It should meet academic standards relating to knowledge and understanding of the moral domain in much the same way as do other areas of study. This paper briefly explores the aims, subject matter and methods of such an undertaking from a philosophical point of view. The approach helps to overcome the common dichotomy in which students are regarded as moral beings so far (...) as their general conduct is concerned and as amoral beings when it comes to the subject matter that they study. When integrated into the curriculum, it brings out the moral aspects of various areas of study and assists students to understand them. (shrink)

The chapter explores Johan Galtung’s theory of cultural violence from the perspective of a hegemony centered account of the social. It argues that once we take hegemony as a central organizing idea of the social, it becomes possible to recognize the limits of Galtung’s account of cultural violence and why his response to it remains weak. It defends a politics of contestation and a politics of disruption as possible ways to counter the risks introduced by cultural violence.

In Fact, value and philosophy education I tried to show how philosophy can help to overcome the fact-value divide that continues to plague education. In attempting this, I applied John Dewey’s suggestion that philosophy may help to integrate beliefs about matters of fact with values in society at large, to the curricular division between subjects that deal with knowledge of matters of fact and those that are largely devoted to subjective understanding and personal expression. The paper centres on the claim (...) that philosophical dialogue about what we should believe and value can help to effect a mutual adjustment between our reason and our sentiments and bring us to think as whole human beings. It argues the case by first looking at the use of reflective practical reason to effect a change in our desires and conduct when we deem them to be undesirable. The use of reason to provide us with courses of action and other practical remedies to deal with what we see as defects in our character suggests that our cognitive and affective powers are capable of working together through mutual adjustment. By extension, I argue that reason can help us to examine the moral dimension of problems and issues in various areas of study, while making our understanding of them responsive to our feelings. The introduction of an educational means to give effect to this mutual adjustment brings us back to the role of philosophy. Philosophy provides the opportunity for reasoned dialogue that brings the factual material that students encounter into connection with what they are learning to value. It brings a normative cast to the study of history, society, literature, art, science and technology and enables the knowledge that students gain through their studies to be applied to matters of value. In general, it brings moral sensitivity to all kinds of subject matter and enables students to apply their knowledge and intelligence to the formation of values. In the years since I wrote this piece, I had the privilege to assist with the initial draft of documents on ethical understanding as a general competence in the Australian national curriculum and of constructing and implementing a pilot program for ethical inquiry in New South Wales primary schools, which led to ethics becoming an option for students who do not attend religious instruction. In different ways, both experiences brought home to me the importance of incorporating considerations of value throughout the curriculum and the value of philosophical inquiry as a means of doing so. Reflection on these experiences resulted in my book Teaching Ethics in Schools. (shrink)

The paper considers the democratic value of the recent public sphere movements—from Occupy Wall Street to Taksim Gezi Park, from Tahrir Square to Sofia. It argues that the mainstream models of democracy fail to grasp the significance of these movements and the emergent political forms within these movements due to their narrow account of politics and democracy. To fully grasp the democratic value of recent public sphere movements, we should approach them from an agonistic perspective. Once democratic politics is viewed (...) from an agonistic perspective, it becomes possible to recognize that while expressing their critique of existing liberal democratic institutions, the recent public sphere movements contested the dominant understanding of democracy and staged an alternative vision of democracy, democratic culture, and new forms of citizenship. From Cairo to Occupy Wall Street, from Istanbul Gezi Park to DANS protests in Sofia, in recent public sphere movements we have witnessed the emergence of a new wave of creative protest. The surge of creative forms of political action brings to the fore the question of democratic potential of creative political protest. This paper explores in what ways creative protest could deepen democracy. I argue that creative political protest nurtures democracy by generating a peaceful culture of resistance and by (...) providing a peaceful way of responding to politics of intolerance and polarization. How can school education best bring about moral improvement? Socrates believed that the unexamined life was not worth living and that the philosophical examination of life required a collaborative inquiry. Today, our society relegates responsibility for values to the personal sphere rather than the social one. I will argue that, overall, we need to give more emphasis to collaboration and inquiry rather than pitting students against each other and focusing too much attention on ‘teaching that’ instead of ‘teaching how’. I (...) will argue that we need to include philosophy in the curriculum throughout the school years, and teach it through a collaborative inquiry which enables children to participate in an open society subject to reason. Such collaborative inquiry integrates personal responsibility with social values more effectively than sectarian and didactic religious education. (shrink)

This chapter considers what Ender's experiences tell us about the differences between liberal education, vocational training, critical inquiry, and that elusive matter of freedom in, and as a result of education. Specifically, the chapter addresses the following questions: Does everyone need a liberal education? Are schools training grounds for the workplace? And finally, is critical inquiry essential to being an educated person? Ender does get a kind of liberal education with three core aspects. First, in terms of comprehension and performance, (...) Ender learns about military history, military tactics, and strategic‐oriented mathematical calculations in the classroom. Second, he develops problem‐solving skills in the cyber‐reality of the computer game, the Giant's Drink. Third, in terms of interactive performance and cognition, Ender learns about hand‐to‐hand combat and command in the simulated war games of the battleroom. Ender's Game illustrates just how different views of pedagogy can intermingle and conflict with one another. (shrink)

The resurgence of religious movements all over the world, their varying claims to identity and politics, and their success in generating system-transforming effects in both national and world politics have indicated clearly that there is a need to uncover the invisible interconnections between religion and politics. Moreover, the way in which religion has been striking back has taken different forms. From religious and terrorist fundamentalism to multiculturalism, from communitarian claims to the religious state to religion-based civil societal calls for pluralism (...) and freedom, it is possible to see different articulations of the resurgence of religion in the world in which we live. In this context, Turkey constitutes a sociologically illuminating, theoretically challenging and politically timely case study. As a modern republic on the margins of Europe and preparing for accession negotiations with the European Union for full membership, Turkey is both a Muslim society and a strictly secular nation-state. This article suggests, first, that the process of modernization and democratization in Turkey has always faced the problem of establishing a delicate balance between politics and religion, and, second, that in this process the more secularism is used by the state elite to control religion, the less pluralistic and democratic the state has become in governing a society where Islam has always played an important role in the symbolic formation of Turkish identity. What is needed in this context is a ‘democratic secular imaginary’ as a more dialogical, tolerant and accommodating strategy of living with difference, enabling us to understand religious claims to difference in their own right, and to approach them clearly and critically.
